If He Kills Another Woman the Blood Will be On Judge James Ahler's Hands

In a clear case of judicial arrogance Judge James Ahler refused to grant the California Medical Board's request for the emergency suspension of Andrew Rutland's medical license after an undercover sting conducted by Board investigators caught him doing first trimester chemical abortions, even though he has been banned from the procedure. Not only did the judge allow Rutland to keep his restricted license, he indicated that Rutland may continue to do early medical abortions that do not require surgery.
The abortionist's license was partially suspended on 7 January 2010 after Ying Chen died from a botched second-trimester abortion Rutland performed at what has been described as a dirty, ill-equipped acupuncture clinic in San Gabriel. He was banned from surgery & from doing abortions. Rutland asked for permission to continue doing first trimester abortions, but on 12 January, the Board issued a clarification specifically banning him from that practice.
"Folks, this is not a referendum on abortion," Ahler said, explaining why he dismissed the California Medical Board's petition for emergency suspension of Rutland's license. Who ever said it was? This is about his refusing to obey the conditions of his suspension, which did ban him from performing abortions.
After the hearing, Kathleen Nicholls of the California Medical Board had the following comment: "How many patients have to die before a doctor is shut down? It's unfortunate someone else is going to have to die to change this order."
Fortunately the California Medical Board isn't going to let it rest at that. The Board has stated that it will now press forward with a full Board hearing to revoke Rutland's license "as expeditiously as possible."
This isn't the 1st time Rutland's license has been suspended. It had been previously revoked in 2003, after his negligence caused the death of a wanted baby during childbirth. At that time he was on probation for the deaths of two other infants. In fact, a two-year state investigation resulted in accusations of negligence, misconduct and incompetence in his treatment of 20 pregnant women, newborns and gynecological patients.
The clinic has an even worse track record. According to LifeSite News Rutland took over the Chula Vista abortion clinic from abortionist Nolan Jones, who had his license revoked in March, 2009, for violations ranging from botched abortions to fraud. Jones had replaced unlicensed abortionist Bertha Bugarin, who is serving nearly 7 years in state prison for illegal abortions. Bugarin had stepped in after abortionist Phillip Rand surrendered his medical license due to his part in killing a woman during a botched abortion in Santa Ana in 2004.
IMHO the judge's bit about this not being a referendum on abortion is a cop out. As I already pointed out, this is about a doctor who has a long record of medical malpractice resulting in several deaths who refuses to obey the conditions of his suspension. Apparently Judge Ahlers is more concerned about supporting abortion even when done by a incompetant physican than caring about the women who may be the victims of that incompetance. All Judge Ahlers is doing is abetting the abortion industry in its coverup of the harm "legal abortions" does.
The abortion industry likes to claim that legal abortion makes it safe for women. They claim that back-alley abortions done before Roe v Wade were done by amateurs & resulted in huge numbers of woman dying as a result of those botched abortions. The truth is different. Former abortionist Dr. Bernard Nathanson admitted thse numbers were inflated. 2ndly, the reason the abortions were called back alley was because that was the entrance the women used to the doctor's offices who did the great majority of those illegal abortions. Finally, the number of deaths went down long before Roe v Wade & Doe v Bolton because of the increased use of anibiotics. Not because abortions were now being done by competant doctors.
I hope the Board moves quickly to permanant suspend Rutland's license. My only concern is will Ahlers then do a bit of judicial activism & overrule the validly arrived at suspension because it is, in Ahler's mind a referendum about abortion & to suspend it is to show the truth about how abortion is not as safe as the industry would like it to seem.
