Philosophical Question of the Day - 13 June 2009

I have the encore showing of EWTN's The World Over Live on streaming video. Raymond Arroyo was talking to Wendy Long, Legal Counsel to The Judicial Confirmation Network, about the nomination of Judge Sotomayor. The question that Sen. Jim DeMint asked her & her response came up. He shared the following from his meeting with her: "When I asked if an unborn child has any rights whatsoever, I was surprised that she said she had never thought about it."
Wendy Long (who worked at the Supreme Court for Justice Thomas) was surprized as well. She pointed out that somewhere along the way, at least in Sotomayer's law school studies, it had to come up that the unborn had property inheritance rights.
So my question is this: "How can an unborn child have property inheritance rights if he/she is not a human being with the right to life?
