The bad news, it was only for practice of a health care profession resulting in serious bodily injury, a second degree felony, and with tampering with or fabricating physical evidence, a third degree felony. & not for murdering the newborn child.
Belkis Gonzalez was arrested on Tuesday and jailed on two felony counts related to the death of a baby, named Shanice, who was born alive after the botched abortion in the 2006 case. If she is convicted of unauthorized practice of medicine, she would face at least a year in prison and up to 15 years maximum. The other charge, tampering with evidence, carries a maximum five-year prison sentence.
Wait til you hear what her lawyer has to say about the charges. Alberto Milian, told the Sun-Sentinel that the charges are bogus because pro-life groups asked local officials to bring them. According to him, being pro-life disqualifies someone from insisting the law be enforced. What Constitution is he using?
& while it is good to at least see some charges being filed, the fact remains, Shanice was born alive & was murdered. Gonzalez should be charged with that as well.
The abortion practitioner in the case, Pierre Renelique, had his medical license revoked last month by the Florida medical board. It found him guilty of medical malpractice and wrongly delegating a medical responsibility meant for physicians to unlicensed personnel. Again, why haven't any criminal charges been filed against him?
The Sun-Sential reports: "According to Gonzalez's arrest affidavit, Miami-Dade's Chief Medical Examiner Bruce Hyma issued a certificate of live birth, because nothing in the autopsy findings refuted a witness report the infant was moving after the delivery. The affidavit said he concluded gas bubbles found in the lungs were most likely a byproduct of decomposition of the fetal remains.The cause of death was listed as extreme prematurity and the manner of death was classified as natural."
Given that the baby was 23 weeks old, that last bit sounds a bit questionable as 21 week year old premies have survived. The fact is, nothing was done to even try to save the baby which is what should have happenned. It may be difficult for it to be proven, difficult. but not impossible. It sounds to me like the State attorney is using this as a copout.
