The frivilous lawsuit craze has made it to Russia. According to a report on Ananova titled Woman sues after drinking 5,000 litres of Coke, Natalya Kashuba, 27, drank up to 3 liters of Coca Cola a day for 5 years. She did so to collect caps & turn them in for prizes. She claimed that after drinking all that Coke she developed insomnia & heartburn. According to her lawyer, Alexey Monakhov, "In October 2005, as a result of an examination by a gastroenterologist, she was diagnosed with a chronic condition whose main symptom is heart burn."
2 Russian courts held Coke to blaim for not warning of the potential health risks of drinking too much Coke & awarded her 3,163.76 Russian Roubles ($119.75). She is seeking an additional 3,010,673 Roubles ($113,958) in what she calls "moral damages".
OK where does common sense & greed on her part fit into this? & for that matter, what about personal responsibility for her actions? Part of the evidence entered in were the dozens of inflatible mattresses & radios that she had gotten for the caps she turned in. In my mind she joins the ranks of those here in the USA that sued McDonalds for making them fat. At least the judges here in the USA have so far had the sense to throw those cases out.
